Version v5 (May 2026). Adapted to the Workstation on Demand (pay-per-use) model and customer responsibility for third-party software. Previous versions remain binding for services contracted before this date.
Customer-installed software and BYOL
LilDesk provides cloud compute infrastructure and, unless expressly stated otherwise in a specific product, does not sell, rent, include, activate or sublicense Microsoft Windows, Microsoft Office, Windows Server or any other third-party proprietary software. If you install, upload, request or use any proprietary software inside a VM, you are solely responsible for holding valid licences and for ensuring that those licences include any required virtualization, remote access, hosting, outsourcing, VDI or bring-your-own-licence (BYOL) rights.
You must not use product keys, activation tools, images or software in breach of the applicable licence terms. We may disable or remove a VM, image or service request if we reasonably believe it infringes third-party software licensing terms or if we receive a rights-holder, provider or regulatory notice.
1. Acceptance of terms
By accessing and using the LilDesk website and services (“Services”), you accept these Terms of Service. If you do not agree, please do not use our Services.
2. Service description
LilDesk provides an on-demand cloud workstation service: Ubuntu Linux virtual machines (VMs) with fixed specs by tier, hosted in the Hetzner Online GmbH datacenter in the European Union (Falkenstein — Germany), managed through the customer panel and accessed via the RDP protocol. The current specs for each tier are shown in the configurator before checkout.
3. Pay-per-use billing model
The Workstation service is billed monthly with two components:
- Fixed monthly base according to the contracted tier (Nano, Mini, Essential, Pro or Power), billed at the start of each billing period.
- Actual hours of use: a “peak” hourly rate (Monday to Friday, 8:00–20:00 CET) and a reduced “off-peak” rate (all other hours), both according to the tier. Hours are counted in RDP sessions started by the customer and billed at the end of the month.
The current amounts for each tier (monthly base and peak/off-peak hourly rates) are shown in the sign-up configurator and in the customer panel before confirming the order.
You can change tier and cancel your subscription at any time from the panel or the Stripe billing portal. Changes are applied pro rata.
4. Auto-shutdown and idle policy
To reduce your bill, your workstation is automatically powered off after 30 minutes of inactivity. The usage meter stops when the machine is off. Your persistent disk and /home data remain intact. After 24 hours powered off, the physical resources are released; the next boot may land on a different host. There is no data loss in these states: your persistent storage remains intact.
5. Cancellation and data retention
When you cancel a workstation subscription, the VM and its disks are deleted immediately. This includes /home, installed applications, configuration and any data saved inside the machine. There is no grace period or subsequent recovery. Make sure to back up anything you need before cancelling.
6. Data loss and backups — your responsibility
Your workstation is a compute service, not a backup service. You are solely responsible for keeping your own backups of any data, code or files stored on your workstation. To the maximum extent permitted by applicable law, LilDesk is not liable for any loss, corruption, deletion or temporary unavailability of your data, including (without limitation) loss caused by hardware failure, a failed boot after shutdown, your own actions, or subscription cancellation. Any operational backups we keep exist for our own service continuity, are not guaranteed to the customer, and we do not commit to restoring individual customer data from them.
7. Acceptable use
You agree not to use the Workstation service for illegal activities, cryptocurrency mining, hosting public internet-facing services (the VM is on an internal vSwitch with no public IP by design), bulk unsolicited email (spam), or any activity that violates applicable laws or the terms of use of Hetzner Online GmbH.
We reserve the right to disable a workstation that we detect consuming disproportionate resources without user activity (e.g. mining disguised as feigned idleness).
8. Data and privacy
The use of our Services is also governed by our Privacy Policy. Your workstation data (persistent disks) is stored on a server located in the European Union (Falkenstein — Germany). Applicable GDPR compliance.
9. SLA and availability
We commit to reasonable service availability. The underlying infrastructure (Hetzner Dedicated + Proxmox) has a historical availability above 99.5%. We do not offer a contractual SLA with penalties on the standard tier. For a contractual SLA, we can discuss a separate enterprise agreement.
10. Limitation of liability
LilDesk provides the Services “as is” without warranty of any kind. We are not liable for indirect, incidental or consequential damages arising from the use of the Services. Our total liability is limited to the amount you paid for the Services in the 12 months prior to the claim.
11. Governing law
These terms are governed by the laws of Spain. Disputes will be resolved in the courts of Spain, without prejudice to the mandatory consumer protection rules of the customer’s country of residence within the EU.
12. Changes to the terms
We may update these terms occasionally. We will notify you of significant changes via email or through the Services. Continued use after the changes constitutes acceptance.
